House Bill Would Require Insurers Covering Gender-Affirming Procedures to Also Cover Detransition Care
Rep. Diana Harshbarger (R-Tenn.) has introduced the TRUTH in Coverage Act, which would require health insurance companies that cover gender-affirming procedures to also cover detransition care and treatment for adverse effects. The bill would amend three federal statutes governing private health insurance and would take effect January 1, 2027, if enacted. It currently has 12 cosponsors.
Rep. Diana Harshbarger, a Republican from Tennessee with a pharmacy background, introduced legislation that would create a federal requirement for insurers: if a plan covers what the bill calls "sex-rejecting procedures," it must also cover care needed to address complications, adverse effects, or reversal of those procedures. The bill would apply regardless of state or local laws and would prohibit insurers from adjusting copays, deductibles, or treatment limitations in response.
Fox News, the sole source covering this story, led with Harshbarger's argument that patients who wish to reverse gender-affirming procedures face a financial "one-way door" — able to receive coverage going in but denied coverage for care on the way out. "It's outrageous that a health plan can cover sex-rejecting procedures but refuse to cover the restorative care patients need to address the harm they cause," Harshbarger said.
The bill would amend the Public Health Service Act as well as statutes governing employer-sponsored and group health plans. Fox News noted that the legislation is considered unlikely to become law due to anticipated Democratic opposition in the Senate, though it draws attention to a broader policy debate about insurance coverage gaps for people who have undergone and later sought to reverse gender-affirming procedures.
